Property valuation for inheritance

Inheritance brings blessings, but often also worries. Is the high inheritance tax weighing you down? Is a co-heir making demands or do you yourself want to be paid out within a community of heirs?

The tax office defines the property value as the basis for taxation according to a greatly simplified procedure. An inspection is not required. Diminishing defects such as high wear and tear on the property are thus not taken into account. The values, which in case of doubt are inflated, then do not reflect the actual market value. In accordance with § 198 of the Valuation Act, heirs can document the lower value by means of an independent appraisal and reduce the tax burden incurred.

 

Especially in the case of family inheritance disputes, it is advisable to have the property valued by an expert in order to avoid disputes. In the case of a high-value real estate inheritance, you should play it safe.

Real estate valuation in the event of divorce

A divorce does not only hurt emotionally. Are there joint properties, is a payout pending, do you have to calculate the gain from property ownership or do you want to know the financial consequences in advance of a divorce?

If there are real estate assets in a marriage, the gain must usually be determined in a divorce according to § 1373 BGB. This is usually the case regardless of whether the property is jointly owned or only one of the spouses is registered in the land register. It is not uncommon for other contentious issues to require clarification, such as work or cash contributions made by one spouse to the property. The potential for dispute is particularly high here.  It makes sense, promotes litigation and saves costs to involve both spouses in the clarification. An objective, independent assessment by a publicly appointed expert is recommended in advance.

Property valuation for submission to the tax office

The tax authorities always want to know exactly. Do you want to include a property in the business assets or separate it out? Do you have to pay inheritance tax? Does the tax office ask about the fair market value of your business real estate?

When transferring a property during your lifetime, you can agree on residential, usufruct or annuity rights if you want to continue using the property. Legally binding entries in the land register affect the market value. Seek advice from a public expert at an early stage.

The tax office determines the fair market value (land value) of a property according to a very simplified calculation formula regulated by law, usually without prior inspection. Documents and facts that would contribute to an objective valuation are generally not taken into account. The actual situation is not examined in detail. If the valuation turns out to be too high, the taxpayer can turn the situation around by "proving the lower value" (according to § 198 BewG) with the help of a market value appraisal.
